1. Application of our Privacy Policy

This Privacy Policy applies to the use of our website (the "Site"), as well as products and services owned and operated by us (the "Services"). Note, however, this Privacy Policy does not apply to your use of unaffiliated sites to which our Site only links. Once you enter another web site (whether through an advertisement, service, or content link), be aware that we are not responsible for the privacy practices of that site. Also, this Privacy Policy only covers information collected on our Site and does not cover any information collected by us through other means, such as direct mail, paper applications, submitted forms, etc.

Our Privacy Policy answers the following questions:

  • What information do we collect about users/patients and how do we use it?

  • Will we share personal information with third parties?

  • What choices do users/patients have about the collection and use of personal information?

  • What security measures do we take to safeguard personal information?

2. Information Collection and Use - General
We collect personal and non-personal information to customize the content and advertising you see, fulfill your requests for products or services, and improve our services to you. There are many aspects of our site that can be enjoyed as a visitor, but you need to register in order to take full advantage of the services we provide.


Registration:
When you register for the site, we collect personal information from you such as your email address and password. Registering allows you to access health content whenever you come to our site.


Search:
When you search on our site, we store the search terms and the site(s) visited so that we can continuously improve the quality of our search results.


Cookies:
We collect anonymous information about your use of our site through cookies. The cookie does not tell us who you are. Only you can tell us that. The information collected by cookies helps us generate customized content, such as conditions and news that may be important to you, and also allows us to statistically monitor how many people are using our site and for what purposes. We do not store any identifying information in any cookies on your computer. Your browser software can be set to reject all cookies or to accept cookies only from our Site. Most browsers offer instructions on how to reset the browser to reject cookies in the "Help" section of the toolbar. If you reject our cookies, you may not be able to log in or use certain functions and conveniences of our site.


3. Sharing of Information With Third Parties
iHealthNetworks, INC. is the owner of the information collected on this Site. We know how important it is to keep the information that you have entrusted to us confidential, that's why we will not rent, sell or share any personal information about you. From time to time we may have promotions with partners where we provide a web link that allows you to have some of the personal information (for example a Personal Health Record (PHR)) that you have loaded onto our Site transferred to the partner site. Any such sharing of information with a partner site will be at your option. Once your information is transferred to a partner site, its use will be governed solely by the partner’s terms of use and privacy policy and not our Terms of Use or Privacy Policy, and we will not be responsible for the use of the PHR by such partner or otherwise outside of our Site. You should not transfer your PHR to a partner site unless you have read and agree to such partner’s terms of use and privacy policy.


4. Choices
Whenever reasonably possible, we will offer you choices when we ask for personal information and tell you why we collect different types of information. You may always decline to provide personal information to us and/or refuse cookies in your browser, although some features or services may not function properly as a result. To make it easy for you to make the choices that are right for you, we provide the following controls:


Public & Private:
All stories posted are public, but private messaging is for private discussion.


Communications:
Email communication that you send to us via the email links on our site may be shared with a support representative, employee, or the expert that is most likely to be able to address your inquiry. Please do not provide personal health information in your email unless you are doing so anonymously; regardless, we will only use such information for the purposes of answering your email. From time to time, we may send you service-related emails, such as a welcome email when you register with our site. If we find your personal question valuable to community discussion, we reserve the right to anonymously post your question on the site by removing any names or personal identification, including photos and username.


If you utilize Services for the purpose of creating a PHR, the information and contents of the PHR section of your account will remain private, will not be accessible by other users of the Site, and will not be sold, shared with or given to any individual or entity for marketing purposes. Notwithstanding the foregoing, to the extent we partner with third parties who provide PHR-related services, you may have the option of sharing your PHR data with such third party partner. While we take reasonable measures to safe guard the privacy of our Site and our members we will not accept responsibility or liability for consequences resulting from inappropriate, malicious or criminal actions directed against our Site or PHR or other personal information of our members contained within the Site and our servers.


5. Message/bulletin boards
Users of message/bulletin boards that may be on our Site should be aware that when they voluntarily disclose personally identifiable information (e.g., name, e-mail address, user ID with first and last name, etc.) on a message/bulletin board or other interactive area where personal information can be posted, the information can be collected and used by other internet users. This may result in unsolicited messages from other posters or parties. We make no representations and undertake no obligations as to the security of information you voluntarily post in message/bulletin boards.


6. Our commitment to children's privacy
A special note to parents: This Site is not directed to children and we will not request any information from children under 13 at this site. We have developed our privacy practices as they relate to children from guidelines established by the Children's Advertising Review Unit (CARU) and in compliance with the requirements established by the Children's Online Privacy Protection Act of 1998 ("COPPA"). We also recommend that parents monitor their children's Internet activities and learn and employ software or other tools which can help their children enjoy the fun and entertainment of an on-line experience without compromising their personal safety or allowing them to use the Internet in a manner inconsistent with their parents' preferences.


7. HIPPAA
THIS POLICY DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION.
This policy provides you with information to protect the privacy of your confidential health care information, hereafter referred to as protected health information (PHI). The policy also describes the privacy rights you have and how you can exercise those rights. Your PHI may be used or disclosed for the following purposes based on your registration as a member of our Site:


Treatment Purposes:
Your PHI may be used by and disclosed to other health care professionals for the purpose of providing you with health care services. This may also include the need for us to obtain PHI from your previous health care providers. For example, information obtained by a nurse, physician or other member of your healthcare team will be recorded in your medical record and used to determine the course of treatment that should work best for you.


Payment Purposes:
Your PHI may be used by and provided to your health plan or insurance provider for the purpose of receiving payment for health care services. Your insurer also has a right to access your health care information for payment determinations or for conducting quality control inspections. PHI may also be disclosed to comply with workers compensation laws and similar programs. Your PHI may be shared with other healthcare providers, if necessary, for payment purposes.


Business Associates:
There are some services through our Site that are provided through relationships with business associates. Your health care information may be used by or disclosed to our business associate(s) to provide and bill for services. These business associates will sign an agreement that requires them to have procedures in place to protect the privacy of your PHI.


Your PHI may be used or disclosed for the following purposes based on your opportunity to agree or object:


Notification of and Communication with Family:
Your PHI may be used or disclosed to notify or assist in notifying a family member, personal representative or another person responsible for your care of your location and general condition. Health professionals, using their judgment, may disclose to a family member or any other person you identify, health information relevant to that person's involvement in your care or payment related to your care.


Your PHI may be used or disclosed for the following purposes without your consent, authorization or opportunity to agree or object:


As Required by Law:


Your PHI will be used or disclosed when we are legally required to do so. If this occurs, we will limit the PHI used or disclosed to the minimum necessary to comply with the law.
Inmates:


If you are an inmate, your PHI may be used or disclosed to the correctional institution or agents thereof when necessary for your health or the health and safety of others.


Emergencies:
Your PHI may be used or disclosed in an emergency treatment situation. Your acknowledgement will be obtained as soon as practicable following the emergency.
To Avert a Serious Threat to Health or Safety:


We may use and disclose PHI about you when necessary to prevent a serious threat to your health and safety or the health and safety of the public or another person.


Organ Procurement Organizations:
Consistent with applicable law, we may disclose PHI to organ procurement organizations for the purpose of organ and tissue donation and transplant.


Military:
If you are or have been a member of the armed forces, we may release PHI about you as required by military command authorities.


Research:
We may disclose PHI about you for research purposes when the research has been approved by an institutional review board and privacy protocols have been established.


Public Health Authorities:
As required by law, we may disclose your PHI to public health or legal authorities charged with preventing or controlling disease, injury or disability. For example, reporting births and deaths; reporting suspected abuse or neglect; and, reporting communicable disease information as required by public health authorities.


Health Oversight Activities:
We may disclose PHI to a health oversight agency for activities authorized by law, including, for example, audits, investigations, inspections, medical device reporting and licensure.


Lawsuits and Disputes:
If you are involved in a lawsuit or dispute, we may disclose medical information about you in response to a court or administrative order. We may also disclose medical information about you in response to a subpoena, discovery request, or other lawful process by someone else involved in the dispute, but only if efforts have been made to tell you about the request or to obtain an order protecting the information requested.


National Security and Intelligence Activities:
We may release PHI about you to authorized federal officials for intelligence, counterintelligence, and other national security activities authorized by law.
Your PHI may be used or disclosed for other purposes not identified above based on your signing a specific authorization form. You can revoke this authorization at any time provided you submit the revocation in writing to iHealthNetworks, INC. However, iHealthNetworks, INC. is unable to "take back" any uses or disclosures that were made pursuant to the authorization prior to its revocation.


Your Health Information Rights.
Right to Request a Restriction of Uses and Disclosures:
You have the right to request a restriction on our use and disclosure of your PHI. In your request, you must tell us (1) what information you want to restrict; (2) whether you want to restrict our use, disclosure or both; and (3) to whom you want the restrictions to apply, for example, disclosures to your spouse.


Right to Request Confidential Communications:
You have the right to request that we communicate with you about your PHI in a certain way or at a certain location to protect the confidentiality of the information.


Right to Inspect and Copy:
You have the right to request to inspect and obtain a copy of your PHI. There are a few exceptions to this right such as psychotherapy notes.


Right to Amend:
You have the right to request that we amend your PHI that we created if you feel that the information is incorrect or incomplete.


Right to Receive an Accounting of Disclosures:
You have the right to request that we provide you with an accounting of certain disclosures of your PHI. Standard disclosures such as disclosures to you or disclosures for treatment, payment and health care operations would not be included in the accounting. Your request must state a time period for the accounting. We may charge a reasonable fee for accountings.


Right to File a Complaint:
You have the right to file a complaint if you believe we are not in compliance with our Privacy Policy and the Healthcare Information Portability and Accountability Act (HIPAA) or if you believe your privacy rights have been violated.


We retain the right to make retroactive and non-retroactive changes to this Privacy Policy.
